Terms and Conditions

1. Scope of Services

NexTek provides Internet, Home Phone, and Television services to customers in Canada. These services are governed by the terms and conditions outlined herein unless otherwise specified.

2. Service Availability

Service availability is subject to geographic location, infrastructure, and technical feasibility. NexTek does not guarantee universal availability of services.

3. Installation and Equipment

NexTek reserves the right to install necessary equipment for service delivery. All equipment remains the property of NexTek unless otherwise agreed upon in writing.

4. Service Interruptions

NexTek shall not be held liable for service interruptions caused by third-party providers, infrastructure failures, or force majeure events.

5. Acceptable Use

Clients must comply with applicable laws and refrain from using services for unlawful purposes. NexTek reserves the right to suspend or terminate services in case of misuse.

6. Billing and Payment

Charges for Internet, Home Phone, and Television services will be included in the client’s monthly invoice. Failure to pay may result in service suspension.

7. Termination of Services

Upon cancellation, clients must return all rented equipment in good condition. Failure to do so may result in additional charges.

8. Limitation of Liability

NexTek is not an insurer. Payments are for service only and must not be construed as insurance premiums. NexTek’s liability is capped at 10% of the annual service charge or $500, whichever is greater. NexTek shall not be liable for direct, indirect, incidental, consequential, or punitive damages.

9. Intellectual Property

All content, software, integrations, and documentation provided by NexTek are the intellectual property of NexTek. Clients are granted a limited, non-transferable licence to use these materials solely for the purposes outlined in the service agreement. Unauthorized reproduction, distribution, or modification is strictly prohibited.

10. Data Retention and Breach Notification

NexTek retains personal and non-personal data for the duration necessary to fulfil service obligations and comply with legal requirements. In the event of a data breach, NexTek will notify affected users within 72 hours of discovery, providing details of the breach, affected data, and recommended actions. All data handling practices comply with PIPEDA and applicable provincial laws.

11. Accessibility Statement

NexTek is committed to ensuring digital accessibility for all users. Our website and services are designed to comply with WCAG 2.1 standards. We welcome feedback and strive to improve accessibility features continuously.

12. Cookie and Tracking Policy

NexTek uses cookies and tracking technologies to enhance user experience and analyse website performance. By using our website, users consent to the use of cookies in accordance with Canadian Anti-Spam Legislation (CASL). Users may manage cookie preferences through their browser settings.

13. Dispute Resolution

In the event of a dispute, both parties agree to attempt resolution through mediation or arbitration prior to initiating legal proceedings. Arbitration shall be conducted in accordance with the laws of Saskatchewan, Canada, and held in a mutually agreed location.

14. Force Majeure

NexTek shall not be liable for any failure to perform its obligations due to circumstances beyond its reasonable control, including but not limited to natural disasters, strikes, labour disputes, equipment failure, government actions, or other force majeure events.

15. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Saskatchewan, Canada.
